Application for special authorisation to operate a DLT market infrastructure

Application form and essential elements of the application

The essential elements of an application for special authorisation to operate a DLT market infrastructure (hereinafter referred to as the “application”) are laid down in Articles 8, 9 and 10 of the DLT Pilot Regulation together with Guidelines on standard forms, formats and templates to apply for permission to operate a DLT market infrastructure issued by the European Securities and Markets Authority (hereinafter referred to as the “ESMA guidelines”)

The application should include all information relevant to the applicant required by the ESMA guidelines in accordance with the tables set out in its Annex (external link):

  1. all applicants should provide the following information:
    • Table 1: General information about the applicant
    • Table 2: General information that should be included in an application for authorisation to operate a DLT MTF, a DLT SS or a DLT TSS.
  2. depending on the applicant’s regulatory status and on the nature of its application request, Table 3 and/or Table 4 should be submitted:
    • Table 3: Exemption(s) to Directive 2014/65/EU and Regulation (EU) No 600/2014
    • Table 4: Exemption(s) to Regulation (EU) No 909/2014

Language of the application

The application form, the notification and all related additional information may be submitted in the Czech, Slovak or English language.

As the application may be assessed by several international authorities, the CNB strongly recommends that applicants also always submit the same information in the English language.

Submitting applications

The duly completed application form, the notification and all related additional information must be submitted on a durable medium (a “durable medium” is any instrument which enables to store information in a way accessible for future reference for a period of time adequate for the purposes of the information and which allows the unchanged reproduction of the information stored).

Applications may be submitted in paper or electronic form. For practical reasons, submitting an electronic form using a data box is preferred.

Applications can be submitted in electronic form:

  • from the data box of the applicant (or their authorised representative) to the data box of the Czech National Bank (ID: 8tgaiej)
  • by sending an e-mail to podatelna@cnb.cz signed by the applicant or their authorised representative with a recognised electronic signature (an advanced electronic signature based on a qualified certificate for electronic signatures or a qualified electronic signature).
