Pursuant to Articles 14(1)(a) and 14(1)(b) of Act No. 15/1998 Coll., on Supervision in the Capital Market Area and on the Amendment of Other Acts, as amended, the Czech National Bank publishes in a manner allowing remote access the statements of the final or enforceable decisions of the Czech National Bank in matters governed by this Act or special legal rules.

Decisions in the capital market area are published via the application Final decisions (available in Czech only).

1. Penalty decisions, i.e. decisions on the imposition of sanctions or remedial measures on supervised entities on the capital market are published to the extent of the statement of the final decision, using anonymised information on third parties – i.e. specifying the entity on which the sanctions or remedial measures are being imposed, the amount of the sanction or the remedial measure and information on the effect of the decision.

   In addition to making decisions in the capital market area, the CNB publishes decisions on fines and sanctions imposed on insurance intermediaries listed in the register of insurance intermediaries available at Register of Insurance Intermediaries and Independent Loss Adjusters pursuant to Article 12(3)(j) of Act No. 38/21004 Coll., on Insurance Intermediaries and Independent Loss Adjusters, as amended.

2. Decisions on licences and approvals, i.e. decisions on applications for authorisation (of investment firms, management companies, investment funds, etc.) and applications for consent (to perform the duties of a senior officer, to acquire a qualifying holding, to approve a change in a collective investment fund statute, etc.) in the capital market area pursuant to Act No. 256/2004 Coll., the Capital Market Undertakings Act, as amended, and Act No. 189/2004 Coll., the Collective Investment Act, as amended.

Decisions in the area of public offerings pursuant to the relevant provisions of Act No. 256/2004 Coll., the Capital Market Undertakings Act, as amended, in the area of bond issuance pursuant to Act No. 190/2004 Coll., the Act on Bonds, as amended, in the area of takeover bids pursuant to Act No. 104/2008 Coll., on Takeover Bids and on the Amendment of Other Acts, as amended, in the area of public offers to purchase or exchange participating securities and the right of squeeze-out pursuant to the relevant provisions of Act No. 513/1991 Coll., the Commercial Code, as amended, and in the area of regulated markets pursuant to the relevant provisions of Act No. 256/2004 Coll., the Capital Market Undertakings Act, as amended, are published to the extent of the final statement, specifying the party to the proceedings and information on the effect of the decision.
